The Texas Senate unanimously passed the law Wednesday, banning child sexual abuse materials generated by AI in a move that stated lawmakers would give police better tools to crack down on child exploitation.
Senate Bill 20 by Senator R-Aplesanton “criminates the possession of indecent material that appears to portray a child, whether the depiction is an actual child, cartoon or animation, or an image of an image created using an artificial intelligence application or other computer software. Under the proposal, the crime becomes a felony in a state prison, but the charges can be upgraded against a previous conviction.
“Through AI or other programs, technology will allow child predators to produce obviously offensive material and I don’t think there’s any redemption value at all,” Flores said Wednesday from the Senate floor. “In fact, these materials are often used to raise and abuse children.”
Lt. Col. Dan Patrick, a three-term Republican who will preside over the Senate, praised him for voting SB 20 as a priority for the 89th Congress.
“The surge in pornography generated by AI requires measures to protect Texans, especially children. “Texas law has named SB 20 a priority because we must eliminate all kinds of child pornography and stop the crimes that arise from it.”
The Senate on Wednesday also approved SB 1621, a bill by Senator Joan Huffman of R-Houston. This will include provisions that will make additional changes to the criminal law to tighten the Child Pornography Act and prohibit child sexual abuse material generated by AI.
