Jayne Ponder provides strategic advice to domestic and multinational companies across the industry on privacy, cybersecurity, and artificial intelligence laws and regulations of existing and emerging data.

Jayne’s practice focuses on helping to launch and improve products and services with laws governing data privacy, artificial intelligence, sensitive data and biometrics, marketing and online advertising, connected devices and social media. I’m guessing it. Jayne, for example, regularly advises clients on patchwork during the development of California’s Consumer Privacy Act, Colorado AI Act, and US state data privacy and artificial intelligence laws. She advises clients on drafting consumer notifications, designing consent flows and consumer choices, drafting and negotiating commercial terms, building consumer rights processes, and implementing data protection impact assessments. . Additionally, she regularly partners with her clients to develop risk-based privacy and artificial intelligence governance programs that reflect a dynamic regulatory environment and incorporate actual mitigation measures.

Jayne routinely represents clients in enforcement actions brought by the Federal Trade Commission and the state attorney general, particularly in areas related to data privacy, artificial intelligence, advertising and cybersecurity. Additionally, she will help promote client advocacy in the rules-making process led by federal and state regulators on data privacy, cybersecurity, and artificial intelligence topics.

As part of her practice, Jane advises businesses on preparing and responding to cybersecurity incidents, including drafting, revising and testing incident response plans, conducting cybersecurity gap assessments, vendor involvement, and post-incident violations. It also includes an analysis of obligations under the Notification Act.

Jayne maintains active pro bono practices, including supporting small businesses and nonprofits with data privacy picks and Elder Estate plans.
