On the 25th, the Korea Press Foundation and six media organizations held a general discussion on the “AI Era News Copyright Forum” at a press center in Jung-gu, Seoul. Since launching the forum in March, news organizations have been discussing how to respond to changes in the digital environment, including the protection of news copyrights and generative AI technology.
On the day, a comprehensive discussion was held to share the results of this forum and conduct related discussions. Lawyer Yang Jin-young of Min-hoo Law Office and lawyer Shin Young-woo of Ji-pyeong Law Office, who were members of the forum, announced the results.
When using news content for AI development, the key is whether it is considered fair use. Lawyer Yang said, “It is difficult to qualify as fair use,” adding, “In particular, the modified use and commerciality of the learning data are important factors in determining fair use, and there is a possibility that copyright infringement issues may arise.” Ta. In other words, the output of Generative AI using news articles has the same or very similar purpose as the original work of news articles, which is to provide current information, so it is difficult to meet the requirements for modified use. .
It is difficult to recognize AI developers’ commercial use as fair use. However, some argue that fair use can be recognized as an exception if it is used for public purposes such as research or education. However, attorney Yang countered, saying, “It is difficult to clearly distinguish between commercial and non-profit activities in the development of generative AI, which requires enormous amounts of technology and budget.”
Discussions also took place regarding the standards for calculating usage fees for news content. Lawyer Shin said, “Price calculation criteria can be differentiated based on purpose of use, company size, latest content, contract period, etc.” and “Price can be differentiated based on whether or not it is used.” Is the AI training data for commercial purposes, is the AI company large, is it the latest news, etc. “In a situation where it is still difficult to assess the state of the AI industry, it is easier to set short contract periods on an annual basis,” he said.
Win-win cooperation between AI developers and media companies was also highlighted. Professor Lee Dae-hee of Korea University Law School said, “In order to prevent false information from AI, AI developers are disclosing sources such as articles through RAG (search augmentation generation) technology.This is a win-win for both countries.・This could be a winning point.” AI developers and media companies. ”
