Audit, interaction assessment, evaluation, and “guardrail” are procedures that can minimize the risk of serious penalties.

The development of artificial intelligence (AI) is increasingly focusing on autonomous systems known as “agent AI” that initiate tasks, adapt strategies, and collaborate with other agents and platforms.

Three-quarters of US staffing and recruiting companies reportedly use agent AI in relation to talent acquisition. A quarter of these companies say the technology is a “game changer” especially for talent acquisition and matching. Employment owners are increasingly aware of the great benefits of having a system that allows them to make good connections with candidates after opening hours and on weekends.

Additional risks

Agent AI systems offer enormous opportunities. However, they also introduce an additional layer of uncertainty and technical risk. This goes far beyond the risks associated with using generated AI that operates within more boundaries.

It’s hard to tell a lawyer that there are other business-related issues in the UK and the EU. This is especially true given how challenging these markets are for many at this point, along with various reforms in the UK and EU legislative pipeline. However, the growth in the use of agent AI must be addressed as quickly as possible with AI governance programs. Violation of the legal requirements of transparency in the recruitment context under the EUAI Act and EU and EU data protection laws could lead to up to 7% of EU fines and up to 4% of UK fines. Class action lawsuits by dissatisfied candidates can also become common. Investors will recognize that AI use is becoming increasingly common in adoption, and given the level of fines, they will increasingly expect employers who will invest in addition to compliance in this area. And Hiler begins to ask questions. Perhaps they are afraid that violations from recruiters will also be infected.

Stay ahead

Therefore, in order to stay ahead, it is essential that directors, legal teams and compliance teams have a clear vision and define “guardrails.” The EU AI Act calls for more widespread AI literacy among staff.

Effective AI governance must pay attention to both high stakes applications, such as ensuring the use of AI in talent acquisition, complying with EU AI law, general data protection regulations and other regulations, and complying with everyday situations such as using financial and pay to detect financial and pay. Governance often fails if employees don’t understand the tools they use and the risks they will implement.

Four Steps

Therefore, there are many starting steps that can be taken to minimize the risk of serious fines.

Perform a full audit: Start with a comprehensive audit of AI tools and include usage actions to understand who is using them and what purpose they understand. Assess Interactions: Identify how these AI tools interact with your internal systems and external data sources.

For more insights, Report Agent AI: Why Governance Can’t Wait? It prepares with the help of some clients in different sectors and sets out some learning points regarding the safe use of Agent AI. We have also developed tools that can be used to assess risk and compliance actions in these areas. Please let us know if you need a demo.
